The Legal Victory

United States Supreme Court Associate Justice Samuel Alito, along with Associate Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett repaired a broken Constitution and returned the rights to the people. Alito says it best. “We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely—the Due Process Clause of the Fourteenth Amendment.”

Regardless of one’s views on God and science, constitutional conservatives across America can rejoice today! The United States Supreme Court correctly asserted that no constitutional provision exists to establish the right to abortion. The Fourteenth Amendment’s Equal Protection Clause (Section 1), when interpreted with precision and accuracy, does not even imply abortion could be protected by its provisions.

The Fourteenth Amendment was ratified in 1868. By that year, 28 out of 37 existing states had enacted statues making abortion a criminal offense- even if performed before “quickening” (a baby kicking and moving at approximately four months). By 1910, 36 of those 37 states criminalized abortion at all stages. During a time at which abortion was criminal, it is only reasonable to deduce that the states did not ratify the Fourteenth Amendment for the purpose of establishing a constitutional abortion protection.

Historical analysis and textual interpretation of the Ninth Amendment is no more kind to Roe than the Fourteenth. According to Rob Natelson, a senior fellow in constitutional jurisprudence at the Independence Institute, “the last two amendments in the Bill of Rights—the Ninth and 10th—are what lawyers call ‘rules of construction.’ That is, they tell us to interpret the Constitution in ways that protect federalism.”

One intent of federalism is to protect the people and the states from a tyrannical federal government. The Constitution was written to protect mankind’s natural rights. Since the Constitution fails to explicitly mention abortion as a natural right, any decision regarding it falls upon either representatives elected by the people, or mostly unelected judges. The existential purpose of our Republic is to give the people power. Clearly then, the Ninth Amendment assigns responsibility to state legislatures- not the judicial benches. Roe overturned promotes power to the people.

Author and constitutional historian Jax Hunter states it more clearly. “If the Courts can throw away laws made by the people, a few mostly unelected judges can rule over the majority of the population against their will. This goes directly against the purpose of the United States Constitution, which was to ensure a government ‘of the People, by the People and for the People,’ as Abraham Lincoln put it in his Gettysburg Address.” Roe was an erroneous mishmash that held that abortion is part of a right to privacy that springs from the First, Fourth, Fifth, Ninth, and Fourteenth Amendments. Liberal justices are ensnared in the façade that the Constitution is a living, breathing document. False, words do not change, people’s inferences change. “This position is the great antithesis to the idea of a Constitution, and a Republic.”

The Human Condition

While some conservatives are atheists, or do not believe that life begins at conception, that is not me. I am almost a pro-life absolutist. Regarding rape-induced pregnancies, out of the estimated 6,2 million annual pregnancies in the United States, clinical studies and statistics suggest that roughly 200 women become pregnant due to rape per year. That’s 0.00003 percent of pregnancies. I will not pretend to know how these women feel. I only hope and pray that God provides the mother with more love for the baby than the pain provided by the criminal violator. 24 out of 100,000 (or 0.00024 percent of) American women die from pregnancy or giving birth. Many of these deaths are related to preventable, pre-existing medical conditions. As small as a percentage that is, it’s a tough situation. If I am honest, I don’t have a firm opinion about abortion as a legitimate life-saving intervention.

Multiplying and adding these tragic numbers (pregnancy-related deaths and rape-induced pregnancies) into 6.2 million annual pregnancies reveals a shocking truth. Roughly speaking, and certainly within the same magnitude, 1,488 annual abortions are required to (attempt to) save every dying would-be mother and alleviate every rape-pregnancy victim of emotional distress in the United States. Despite this relatively low number of “necessary” abortions, there were approximately 629,898 abortions performed in America in 2019. Necessary being defined as how the left categorically asserts their position.

For every one abortion resulting from maternal medical danger and rape-induced pregnancies, there were roughly 422 abortions that were for completely unrelated causes during that year. Furthering this notion of abhorrent abortion excesses is a survey, administered by the seemingly pro-abortion group Guttmacher Institute, asking women why they elected to have an abortion. Out of 1,160 statistically significant respondents, the number one reason for abortion is having a baby would dramatically change (interfere with my life). The second most common reason for seeking abortion is can’t afford a baby now. Less than 1.5 percent of women reported having an abortion due to being victims of rape or incest. Additionally, “fewer than 1% said their parents’ or partners’ desire for them to have an abortion was the most important reason.”

No, America is not systemically turning to abortion to alleviate medical crises and the psychological traumas associated with sexual crime. On the contrary, far too many American women (and men, ideologically) have turned to abortion as a procrastinator’s birth control and/or an ill-conceived responsibility antidote. Biologists universally agree that life starts at the moment of conception when unique, never-before-seen DNA is being produced by a zygote (young man or woman trying to live their best life as a single cell before diversifying). To abort (kill) a human for convenience is not only defying God’s law, but also spitting on Thomas Jefferson’s grave and his infamous words that birthed America and made us E Pluribus Unum (out of many, one) “they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness”.

Live-Saving Changes in the Short Term

Now that our Supreme Court, largely thanks to President Donald Trump appointing three Pro-Life Justices, has restored much constitutional vigor to our land, positive change will be rapid. At least 13 states have trigger laws that will “prohibit abortion within 30 days” of the ruling. Eight states have already effectively banned abortion. In total, Attorneys General from 24 states jointly filed an amicus brief encouraging the Supreme Court to overturn Roe v. Wade. “26 states have laws indicating that they intend to ban abortions, according to the Guttmacher Institute.” At the time of this article being published, all states who have indicated their intent to prohibit abortion have created exceptions to prevent would-be mothers from experiencing death or great bodily harm. It remains unclear how many states will ban abortions in the case of rape-induced pregnancies.

Notably, Tennessee will not provide an abortion exception for cases of rape-induced pregnancies, but state lawmakers passed their trigger bill in 2019 with a provision that “prohibits prosecution of a woman upon whom an abortion is performed or attempted.”

As great as it is that more than 50 percent of the states in the Union appear ready to prohibit abortion, if they have not already, it is still a tragedy that roughly 21-24 other states will continue to allow unrestricted abortions. Some states, such as California, are signaling that they may pay for the travel, childcare, and abortion procedure costs for out-of-state women to visit California to receive an abortion. While certainly possible with a governor like Gavin Newsom, spending California tax dollars on non-California residents is unlikely to stand in court.

Woke corporations such as “Walt Disney, JPMorgan Chase and Dick’s Sporting Goods said Friday they would cover employee travel expenses for abortions in light of the Supreme Court’s decision to strike down Roe v. Wade“. It is also true that many economically affluent women will cross state lines independently to receive abortion procedures. Some states, such as Mississippi, are seeking to pass a law that would allow private-citizen Mississippians to bring forth civil litigation against other Mississippi residents, who travel out of state to take part in “abortion tourism”, and the medical practitioners who performed the abortion. This move would be similar to Texas’ S.B. 8. This legislative model is in unclear constitutional waters as states’ abilities to enforce civil procedure laws outside of their own borders have so far been untested in court. While there is much work ahead to save all babies, there is also great reason to rejoice as surely hundreds of thousands of lives will be saved.

The Bright Future for Babies and America

After examining the past and the present regarding abortion in America, it’s time to look to the future. There is reason to celebrate! It may take another 15 to 20 years, but Americans will increasingly view abortion as an abomination to God, humanity, and our country. Over the next two decades, abortions will drastically decrease in blue states and will even be banned in many of them.

Skeptical? Consider the fertility rates in red States versus blue states. People in states who vote for Republican governors and Republican Presidents are having slightly more children. Slightly more is significant over long periods of time. As liberals have less kids, there will be less people to pass along leftists ideologies as political ideology is most often inherited from parents and spouses. Yes, schools are indoctrinating kids, but that won’t last.

More and more red states are fighting this by providing novel school choice programs in the country. Arizona just passed the largest- and best funded- school choice program in the country. West Virginia started rolling out a similarly-massive school choice program earlier this year. There’s an old phrase that goes “liberals don’t have kids, but they raise yours”. All of the recent child grooming exposed by conservative activists such as Libs of TikTok will make liberal child-indoctrination go extinct in red states.

Another thing to consider is that Republicans (and conservatives) are substantially more Pro-Life than liberals and independents. This will contribute to the red fertility advantage. Consider the three charts below from a recent Gallop poll in May.

Republicans are steadily, but consistently showing an increased interest in preserving unborn lives.
Democrats are increasingly viewing abortion as a fundamentally good thing. Anecdotal evidence from social media even suggests that many take great pride in receiving abortions and are proud.
Independents’ opinions have always been more sensitive to political rhetoric. As the left frames Pro-Life as Anti-Woman, independents will swing Pro-Abortion for a short time. As conservative (legacy and social) media is poised to dominate in the coming decade (Web3 will be cancel-proof), independent opinions will shift back to Pro-Life.

Despite Republicans having a fertility advantage, America is in a dangerous fertility crisis that will choke our economy. Roe being overturned will help this. However, an even bigger factor will ensure that America becomes increasingly Pro-Life.

As President Biden allows for 250,000 illegal immigrants to cross the border each month, he probably does not realize that he is administering an extended release poison pill to the Democrat Party and its woke platform. Many of these immigrants will go on to become legal citizens.

While I support immigration reform, and dislike people coming in through the backdoor, it’s not all bad for conservatives. In fact, at least part of our brains should be rejoicing.

Despite declines in religious affiliation similar to the rest of the American population, Hispanic Americans remain overwhelmingly Christian and conservative, even more so than European (white) Americans.

Even as religious affiliation declines among Hispanic Americans, 70 percent report having prayed in the last week. As this data is slightly older, the numbers are probably less, but Latinos still hold a solid religious majority.
As demonstrated by a recent Pew survey, religious commitment is a strong indicator of Pro-Life values. Expect this to remain true with the newly arriving illegal immigrants at the southern border.

The biggest obstacle to winning over more Latinos to the Republican Party is the myth of wide-spread Republican racism. Democrats have been very effective at perpetuating this false narrative using the media, but they have lied so much, that Americans no longer trust the legacy media. In late 2021, only 36 percent of Americans indicated that they have a “great deal” or “fair amount” trust in mass media. The top five percent of conservative and moderate social media influencers alone (YouTube, Instagram Video, Twitter) are already receiving comparable viewership and engagement to massive corporations such as ABC, CNN, NBC, and MSNBC.

When Web3 arrives, it will be impossible to censor conservatives. We will have more influence on the distribution of news than any other time in history. We must use it wisely.

Back to the point about winning Hispanic allies to the conservative movement, it’s happening! Sure, many may vote blue upon arrival, but quickly change their minds after reading their child’s gender studies curriculum,

Representative Mayra Flores, the first Mexican-born member of Congress, is the future of the Republican party. The voters in Flores’ district are 84.5 percent Hispanic. Flores flipped the district red after it was blue for over 100 years. In electoral politics, the significance of this cannot be overstated. The New York Post spoke with Congresswoman Flores.

“She said Hispanic voters see themselves as Americans, while Democrats see Hispanic voters as an ethnic voting bloc. ‘Because of that they felt entitled to our vote,’ Flores said. ‘The problem is they do not represent our values of faith, community, work ethic or the desire to seek better opportunities.’

The Democrat illusion spell is wearing off as the party becomes insanely woke and asserts that there are infinite genders and that children should be allowed to chemically castrate themselves. Call a Latino “LatinX” and see what kind of response you get.

Democrats like to say that “demographics are destiny” and then pretend it never happened. Well, liberals, I would wager that your own words will be your downfall. In a decade, you will yell at one another “Et tu, Brute?” The process has already started.

In short, to God be the Glory for the fall of Roe. When he declared his presidential bid as a Republican, President Donald Trump exposed himself to the most powerful, well-funded, evil people on planet earth. Promises that were made, were kept. He stuck to his convictions. As did the Justices he appointed to the Supreme Court. They received death threats, illegal intimidation tactics at the homes of their families, and even an assassination attempt.

Roe was always unconstitutional and was a figment of the liberal imagination. Despite media-portrayed appearances, America as a whole is becoming more conservative, will return to traditionalism with the new media powers of the right, and millions babies will be given the rights of life, liberty, and the pursuit of happiness. Conservatives will outbreed liberals. Democrats will continue to unknowing assist their electoral enemies to settle in America. With due time, the glutenous abuse of abortion will be banned, even in many blue states. The best is yet to come.
